Random Dumbasses Part 3

So anyways, here is another list of random dumbasses from court. I hope you enjoy!

1) A defense lawyer I saw in court gets nominated for this award. His client was found with marajuana on him after he was found fleeing from the scene of a burglary. There apparently was a call to 911 stating that there was a burglary in progress. The police arrived on the scene and saw the defendant fleeing from the house. He was subsequently stopped. Upon stopping him the police officer noticed a marajuana cigarette sticking out of his pocket. He was then arrested and more weed was found in one of his pockets. His defense lawyer actually argued in cour that a)the police shouldn't have stopped him and b)the cigarette was illegally seized.

NO. a)If you are seen running from the scene of a crime, the police have a right to detain you. b)The weed cigarette was in plain view, thus the police had a right at that moment to place the defendant into custody on that charge. After he was arrested he then can be searched.

The judge, of course, overruled this and found the defendant guilty.

2)There was a dispute between a separated couple. Apparently the break up was a result of the boyfriend sleeping with one of the neighbors. The girlfriend (according to her testimony) was that she confronted the boyfriend about it and he "called her names" and "choked her." She then allegedly left the house to stay with a friend.

The boyfriend's story was quite differently. He stated that she told him when he left for work that day that she was "break up" with him. He stated that was fine. When he was arrived home from work that night, he found his girlfriend's "new" boyfriend at the home. He had to call the police to get the guy out of the house.

After he kicked him out the girlfriend then came back to the house and started shouting threats. The police arrived and threatened to take her to jail unless she left. She then left without further incident.

The weird thing about this case was a)girl thought that her family lawyer (not a prosecutor) could present her case for her b)she stated she wanted to "object" to the judge's dismissal of the charges and c)she kept talking about how he "slept with" the neighbor.

The judge wisely dismissed the charges and told both of them to stay away from each other. I think this case was more over the guy's alleged cheating then any threats his made against his ex-girlfriend. What a waste of the court's time.

Your defense lawyer argument would probably work here in Harris County.
